1. Acceptance of Terms

By accessing or purchasing from tragerbeverages.com (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site or purchase our products.

2. Eligibility

You must be at least 18 years old to purchase from this Site. Our products contain caffeine and are not intended for children.

3. Products and Dietary Supplement Disclaimer

Trager products are dietary supplements, not drugs.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Consult your physician before use if you are pregnant, nursing, taking medication, or have a known medical condition, and before giving this product to anyone under 18. Discontinue use and consult a doctor if you experience an adverse reaction.

This product contains caffeine (150 mg per serving, in both the 12 oz can and the 2 oz shot). Do not combine with other caffeinated products. Not recommended for individuals sensitive to caffeine.

4. Orders, Pricing, and Payment

All prices are listed in USD and are subject to change without notice. The price charged is the price displayed at the time of checkout.
We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or product unavailability.
Payment is processed through Shopify. By placing an order you authorize the charge to your selected payment method.

5. Subscriptions ("Subscribe & Save")

Subscription orders renew automatically at the delivery frequency you select at checkout, and continue until you cancel.
Before you subscribe, we disclose the products included, the price per delivery, the delivery frequency, and how to cancel.
First order discount: new subscribers receive 25% off their first subscription order with code WELCOME25. The discount applies to the first billing cycle only, is limited to one use per customer, and does not apply to 48-count packs.
Ongoing subscriber pricing: recurring orders receive 5% off the standard price, plus free shipping on every subscription order for as long as the subscription remains active.
Cancellation: you may cancel, pause, skip, or change your subscription at any time from your account on the Site, at no penalty and without contacting customer service. Changes take effect for the next shipment if made at least 2 days before the scheduled renewal date.
We charge the payment method on file at each renewal. Please keep your payment information current.

6. Shipping

Standard shipping is $9.00 on orders under $70. Orders of $70 or more ship free, and all subscription orders ship free.
We currently ship within the United States.
Estimated delivery times are estimates only. We are not responsible for carrier delays.
Risk of loss and title pass to you upon our delivery to the carrier.

7. Returns and Refunds

Returns, refunds, and our 30-Day Satisfaction Guarantee are governed by our Refund Policy, which is incorporated into these Terms by reference.

8. Promotional Codes

Discount and promo codes (including dealer-specific codes) are limited to one per order unless otherwise stated, are not redeemable for cash, and may be modified or discontinued at any time.

9. Intellectual Property

All content on the Site — including the Trager name, logo, product photography, and site copy — is owned by Six White Horses 1899 LLC or its licensors and may not be reproduced without permission.

10. Warranty Disclaimer

The products are provided "as is." Except as required by law, we disclaim all warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the products will meet your individual health goals or expectations.

11. Limitation of Liability

To the fullest extent permitted by law, Six White Horses 1899 LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from use of our products or this Site. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability where such limitation is not permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Six White Horses 1899 LLC, its owners, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the products, your violation of these Terms, or your violation of any law or third-party right.

13. Assumption of Risk

By purchasing and consuming our products, you acknowledge that you have reviewed the ingredient list, Supplement Facts panel, and disclaimers, and you assume responsibility for determining whether the product is appropriate for you, including any allergies, sensitivities, medications, or health conditions.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms, the Site, or your purchase of our products shall be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts.

15. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and Subscription & Cancellation Policy, are the entire agreement between you and Trager regarding use of the Site.
